Terms and Conditions
These terms and conditions (“Terms”) are a binding legal agreement between SILVERS ApS (CVR-no. 45420779), you and the experience manager that govern the use of our web application and any related services (collectively the “Platform”).
For the purpose of these Terms, unless the context otherwise requires, the term:
“we”, “us”, or “our” means SILVERS ApS (CVR-no. 45420779).
”you” means the user of the Platform and customer who attends an experience.
“experience manager” means the host of an experience.
“experience” means any experience or similar arrangement purchased or ordered through the Platform.
By creating an account or placing an order through the Platform, you and the experience manager acknowledge having read, understood, and agree to be bound by these Terms and our Privacy Policy.
We are an intermediary platform that facilitates curated culinary experiences through which users may participate in a Silver Dinner/experience, privately hosted by an experience manager.
An experience manager is a Copenhagen resident aged 60 or above with a remarkable life story. Experience managers include architects, musicians, researchers, diplomats, authors, entrepreneurs, and other individuals with unique professional and personal backgrounds. Each dinner/experience is shaped by the identity, experiences, and stories of the individual experience manager.
A Silver Dinner/experience consists of a home-cooked, multi-course meal served in the experience manager's private home. Guests are invited to dine at the experience manager's table and engage in meaningful conversation, typically together with five to eight other participants.
Each experience manager operates independently and is solely responsible for organising and hosting their own Silver Dinners/experiences. Accordingly, users purchase access to the experience manager's unique hospitality, personal stories, and overall experience, rather than merely the meal itself.
We act solely as an intermediary platform facilitating the introduction between users and experience managers. We do not organise, host, manage, or control any Silver Dinner or other experience, all of which remain the sole responsibility of the relevant experience manager, as further described below.
The experience ticket and order confirmation are always sent to the email address provided by you.
Responsibility for the experience ticket is transferred to you as the consumer at the time you receive the ticket.
When you have paid for an experience, the experience ticket is always sent to the email address provided. If you do not receive an email, you should first check whether our email has ended up in your spam or promotions folder. If it is not there, you can contact us directly and get help.
Responsibility for the experience ticket is transferred to you as the consumer at the time you receive the ticket by email, and you should therefore check as soon as possible whether the content of the email and the experience ticket match the order and order confirmation.
Payment
When you purchase an experience through the Platform, payment is made directly to us. Following receipt of your payment, we will remit an agreed portion of the purchase price to the relevant experience manager. Such amount is intended, among other things, to cover the experience manager's costs associated with hosting the experience, including the purchase of food and other related expenses. The amount payable to the experience manager is agreed separately between us and the relevant experience manager.
VAT
All prices on experiences are stated in DKK and include VAT. Exceptions are experiences that, based on their content and nature, are exempt from VAT, cf. the rules of the VAT Act.
Experience gift card
Our gift card is a gift card for a specified amount that can be used as a means of payment.
Our gift cards cannot be combined and must therefore be used individually. Please also note that discount codes cannot be used when purchasing gift cards. Our gift cards are non-refundable.
We reserve the right to cancel the order if this is not observed.
Price and typographical errors
We take reservations for price and typographical errors on our website, social media, newsletters and other email communications, and reserve the right to cancel the order if it is a significant and/or obvious error.
If you choose to cancel
With more than 7 days to the experience, you can rebook by contacting us directly. However, some experiences have special rules for rebooking, e.g. for overnight stays and for experiences that require a long preparation time, and there may therefore be a few exceptions. This will be stated under Rules and security on the experience's product page.
If there is less than 7 days left for the experience, the experience cannot be rebooked. Please note that experiences often involve preparations that involve expenses that must be covered, and you cannot therefore get a refund for the experience.
On the day: If something unforeseen has occurred immediately before or on the day of the experience (e.g. illness), please contact the experience manager so that they know that you will not participate anyway. You will find the contact details in your booking confirmation. Alternatively, you are generally welcome to give your ticket to another party.
Safety and good conditions are the highest priority. Therefore, the weather can sometimes make it impossible to hold the experience. Should this happen, the experience manager will contact you so that you can find a new date together.
If the experience manager chooses to cancel
Our experience manager will of course do everything possible to ensure that you can come out and experience. However, unforeseen events can happen, e.g. in the event of illness, road conditions and the like, where there is no other choice but to cancel. Should this happen, you will be contacted by the experience manager by phone/SMS and then by email.
If the experience manager chooses to cancel due to too few registrants, errors in planning or similar, the cancellation must be made no later than 5 days before the start of the experience.
Regardless of when the cancellation takes place, alternative booking dates must be available and if this is not the case, you are entitled to a refund of the amount for your experience.
In the event of cancellation and questions regarding this, you are always welcome to contact us.
Through our software supplier Holdbar, we use SSL, which means that your credit card information is processed encrypted.
If you pay by credit card, you are protected against misuse because you can reject a payment through your bank. In addition, you have no deductible in the event that the credit card is misused in an online store that uses SSL. SILVERS uses SSL, which means that your credit card information is processed encrypted.
Each experience manager operates independently and is solely responsible for organising and hosting their own Silver Dinners/experience. We are a neutral intermediary. We do not prepare, inspect, store, transport, or guarantee any food, beverages or the like shared at an experience.
Accordingly, each experience manager is solely responsible for the organisation, management, and hosting of their experience, including any acts or omissions occurring in connection therewith. This includes, without limitation, any claims arising from a guest becoming ill as a result of food served during the experience, damage to or loss of personal property, or any other incident occurring in connection with the experience.
To the extent that we are subjected to any claim, demand, liability, loss, cost, or expense arising out of or in connection with an experience and such claim is not attributable to any act or omission of us, the relevant experience manager shall indemnify and hold us harmless against and from any and all such claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees).
Experience managers are encouraged to review their insurance arrangements and satisfy themselves that they maintain appropriate insurance coverage in relation to the hosting of experiences.
Responsibilities for the experience manager:
The experience manager is solely responsible for the preparation, safety, hygiene, quality, accurate description, and legality of the food served by the experience manager.
The experience manager must list all ingredients and clearly flag any allergens (gluten, dairy, nuts, soy, eggs, fish, shellfish, sesame, etc.).
Responsibilities for you:
Tax
Each experience manager is solely responsible for declaring and reporting all income derived from the use of the Platform and for complying with all applicable tax, VAT, social security, and other legal or regulatory obligations.
We accept no responsibility or liability for any tax consequences arising from an experience manager's use of the Platform or the hosting of experiences. Such matters are solely the responsibility of the relevant experience manager.
Disclaimer
To the fullest extent permitted by law, we disclaim all liability for any loss, damage, illness, allergic reaction, or injury arising from food prepared, exchanged, or consumed at an experience or otherwise via the Platform.
Please arrive at least 5 minutes before the start time of the experience. When arriving at the experience, you must be able to document your booking via your ticket or booking confirmation.
